1. General
These terms and conditions (hereinafter referred to as ‘the Agreement’) are adapted for sales on the Internet (distance selling). Hulténs I Sverige AB (Company registration number: 556920-4836) is the selling party. The purchasing party is referred to as (‘the Customer’) in this agreement. The terms and conditions of the Agreement are adapted for sales to private individuals who are at least 18 years of age and to business owners with their place of residence in Sweden and for the sale of goods (‘products’ below). As a customer, you can easily place an order with us at http://www.hultens.se (hereinafter referred to as the ‘Website’).
The provisions of this Agreement do not apply to purchase agreements entered into before 13 June 2014. For clarity, a date is indicated in the header. If the terms of the Agreement have been changed, an end date will also be specified. If an end date is specified, the Agreement shall remain in force until 00:00 on the date on which the Agreement expires. As a customer, you will have the opportunity to accept these terms and conditions when placing your order.
Terms or parts thereof in this Agreement that deviate from mandatory legislation are invalid to the extent that the deviation is not to the benefit of the customer. This provision applies only if the customer is a private individual and the purchase is for private consumption.

2. Order
At Hulténs I Sverige AB, you can order products easily and conveniently. We offer secure payment options and reliable deliveries. Hulténs I Sverige AB receives your order when you click on the ‘Complete purchase’ button in the checkout (step 1 of 1). By clicking on the ‘Complete purchase’ button, you as a customer also accept payment responsibility for your order. When Hulténs I Sverige AB has received your order, you will receive an email entitled ‘Hultens i Sverige AB: New order’ to the email address you provided when placing your order. We also give you, as a customer, the option of placing a quick order through our guest checkout without having to log in to http://www.hultens.se. When you click on the ‘Complete purchase’ button, this Agreement is concluded.
Shop securely with the right to change your order
If you change your mind, you also have the option to change your order. To change your order, please contact us by email at: support@hultens.se. Changes to orders must be notified before the order is packed (processed).

3. Prices and fees
Prices are stated in Swedish kronor (SEK) including value added tax (VAT) according to the applicable tax rate. VAT for VAT-liable products is charged at 25%. Shipping costs may be added to each order, see §7. Delivery in the Agreement for more information.
Fee for uncollected shipments
If you, as a customer, do not collect your order as agreed, we will charge a fee of SEK 195 including VAT. This fee is necessary to cover the shipping and handling costs incurred. Please note that if you do not accept or collect a shipment, this does not count as notification that you have cancelled your purchase. For more information, see §8. Right of withdrawal and return below.
Offers
Offers and promotions advertised on the website are valid while stocks last, unless other terms and conditions are stated in connection with the offer.

4. Products and range
All products offered on the website are designed for use on the Swedish market. This means, among other things, that the products comply with Swedish environmental requirements and safety regulations. Instructions for use in Swedish are normally included if required for the use of the product. Any technical specifications, special requirements for accessories and information about restrictions and seals are stated on the respective product page to the extent that this is reasonable or required by law.
Colour reproduction in product images
The product images displayed on the website shall reproduce the colour and other characteristics of the product as accurately as possible. As colour reproduction may vary depending on the type of monitor you use, we cannot guarantee that the colours of the products will exactly match the colours you see on your monitor.

Hulténs I Sverige AB uses Klarna (Klarna AB, organisation number 556737-0431) as an intermediary for payment processing. Invoice payment is the default payment option, but you can also choose to pay in instalments with a Klarna account, Klarna card payment (VISA & Mastercard, American Express) or Klarna direct payment via your bank. When you place an order on our website, regardless of the payment method, Klarna's applicable terms and conditions will apply to your payment. Hulténs i Sverige AB uses the 3D Secure security solution for card payments.
Invoice payment
When you pay via Klarna invoice, you shop safely and easily. You never need to provide your card details, and you always pay after you have received your goods.

Invoice payment is free of charge. If payment is not received, a reminder fee of £60.00 will be added, as well as interest on arrears of 25.00% plus the applicable reference rate. If no payment is made thereafter, the claim may be handed over for debt collection, which may incur additional collection costs. At the time of purchase, a credit check is carried out, which in some cases means that a credit report is obtained. You will then receive a copy of the credit report by post. Personal data is handled in accordance with applicable legislation. Klarna processes personal data for the purposes of customer analysis, identification, credit checks and marketing. Your personal identity number is used as your customer number for customer management purposes.
Partial payment
The payment method for those who want to choose how much they pay each month. But a Klarna account is more than that. Not only do you always receive your goods before you pay, you also collect all your purchases in one account. This applies even if you have shopped in several different stores via your Klarna account. This means a single invoice, regardless of the number of purchases.

For purchases of £10000 with Klarna Account basic terms, the arrangement fee is £0. The applicable annual interest rate is 19.90%, which corresponds to an effective interest rate of 29.22%. The credit purchase price is £11458. There are 12 instalments, each amounting to £955. The example assumes that payment is made over a period of one year. At the time of purchase, a credit check is carried out, which in some cases involves a credit reference check. You will then receive a copy of the credit reference check by post. Card payment
With Klarna card payment, you can pay with VISA, Mastercard and American Express. Your card will be charged when the order is placed. Klarna handles the card details and is authorised with PCI DSS certification to ensure that the customer's card details are transferred and stored securely in encrypted form.
Direct payment (bank)
With Klarna direct payment, you can pay directly from your bank account. Klarna transfers and protects your information securely in encrypted form when communicating with your bank. For direct payment, you as a customer must be able to log in and identify yourself at your bank. Once you have logged in and approved the purchase with your bank, the payment is complete.
6. Fulfilment
Hulténs I Sverige AB will begin fulfilling this agreement when you click on the ‘Complete purchase’ button at checkout. Hulténs I Sverige AB has fulfilled its part of this agreement when you have received full delivery of the products you ordered. You, as the customer, have fulfilled your part of this agreement when you have made full payment and received delivery of the ordered products in the manner agreed.

Products are delivered directly to the address you provided when placing your order, or via an agent in cooperation with our logistics partners. We also offer you the option of picking up your order directly in store. Hulténs I Sverige AB ships orders on weekdays, excluding weekends.
The stock status indicates whether the product is in stock at the time of ordering. General delivery times are listed below. If your order includes products with different delivery statuses, the delivery time will be the same as for the product with the longest delivery status.
Shipping costs:
The total shipping cost for an order is shown at checkout:
-Shipping cost for parcels to a DHL delivery point is £6.50-18.50 including VAT.
-Shipping cost for home delivery is £25-99.50 including VAT.
Delivery time:
If the delivery times stated below are not applicable to a purchase and if a delivery time has not been specifically agreed outside this agreement, Hulténs I Sverige AB undertakes to deliver without undue delay, but no later than 30 days from the conclusion of the agreement. In the event that the customer is to pay in advance, Hulténs I Sverige AB reserves the right to await payment before delivery begins.
You will be notified when you can collect your parcel from your agent. If you have chosen SMS notification, you will be notified when the shipment can be collected from the agent. Packages sent to a DHL delivery point must be collected within 14 days of the notification date. Uncollected shipments will be returned to Hulténs I Sverige AB, and you as the customer will be charged a collection fee of £19.50 including VAT. Packages sent to a DHL delivery point are a traceable shipping option.
Home delivery in cooperation with DHL (Standard shipping)
Home delivery is made within 3-7 working days, excluding weekends, from the day the order is dispatched from Hulténs I Sverige AB's warehouse. Home delivery is made to your door, with two delivery attempts included. Additional delivery attempts may incur additional charges, so please always contact DHL if you are unable to receive the shipment at the specified time. Home deliveries that cannot be delivered will be returned to Hulténs I Sverige AB, and you as the customer will be charged a recovery fee of £59 per pallet/package for undelivered deliveries, as well as a return fee based on your order. Home delivery is a trackable shipping option.
Pick-up in store
Orders placed for delivery to a store can be picked up within 1 day of placing the order. The products will be handed over to you upon presentation of Hultens i Sverige AB: New order.

Orders placed for store pickup can be picked up within 1 day after placing the order. The products will be handed over to you upon presentation of Hultens i Sverige AB: New order.
Delivery along rural postal routes and in unpopulated areas
If your delivery address is along rural postal routes or in an unpopulated area without a normal bridge connection, the delivery time may be extended by 2-5 weekdays.
Delivery delay
If a delivery delay occurs, you as a customer have the right to cancel this agreement at no cost.
In the event that the purchase was for a product that is to be customised, manufactured or specially procured according to the customer's wishes and Hulténs I Sverige AB cannot take back the product without significant loss, the customer is only entitled to cancel the purchase if the purpose of the purchase has been significantly compromised by the delay and Hulténs I Sverige AB realised or should have realised this.
Transport risk
The risk of shipment passes to you as the customer when it has been delivered to you. This means that Hulténs I Sverige AB is responsible for the transport risk until the shipment has reached you.
Incomplete shipment
If you have not received all the items in your order, this must be reported as soon as it is discovered, but no later than 60 days after you have received the delivery.
8. Right of withdrawal and repurchase
Right of withdrawal
Customers who enter into this agreement as private individuals have the right to withdraw from the agreement in accordance with the Swedish Distance and Off-Premises Contracts Act (2005:59). The right of withdrawal does not apply to customers who have entered into this agreement as business operators. The right of withdrawal applies for 14 days (the withdrawal period), which is calculated from the day on which you, as the customer, received the delivery. The right of withdrawal entitles the customer to examine the goods and return them if the customer withdraws from the purchase. When the customer has cancelled their purchase, they are entitled to a refund of the amount paid, provided that the customer has not used the products to an extent that is greater than what is necessary to examine them. When exercising the right of withdrawal, the customer must notify Hulténs I Sverige AB and then return the products or the part of the order that has been withdrawn to Hulténs I Sverige AB without undue delay, but no later than within 14 days. In the event of a return, the customer shall bear the cost of the return shipment.
Once the customer has notified us that they are exercising their right of withdrawal, Hulténs I Sverige AB will refund the payment without undue delay, at the latest within 14 days. Notwithstanding the above, we reserve the right to withhold the refund until the first of the following two conditions has been met: 1) Hulténs I Sverige AB has received the products returned by the customer, or 2) the customer has provided proof of return. Refunds will be made using the same payment method used by the customer, insofar as this is technically possible. Any deductions for depreciation and shipping costs if the customer has chosen an option other than standard shipping may be made from the refund. In this case, if the order was made against an invoice that has not yet been paid, the invoice will be cancelled. If you, as the customer, return fewer products than the order contains, only the value of the products you return will be refunded.
Deductions for reduction in value when exercising the right of withdrawal
If the customer has handled/used the products more than is necessary to determine their characteristics or function and the handling has caused the products to decrease in value, we are entitled to make a deduction for the reduction in value that has arisen due to the aforementioned handling.
For example, the value of the products may decrease due to wear and tear. In such cases, the customer is liable to compensate Hulténs I Sverige AB for the reasonable decrease in value. A market assessment of the actual decrease in value is made by Hulténs I Sverige AB in each individual case. The deduction levels specified below are only examples of the calculation bases used to calculate the reduction in value. Hulténs I Sverige AB's assessment is always made from an overall perspective. The reduction in value is usually deducted from the refund.
Level 1. - If the product shows minor wear and tear or deterioration, such as a minor scratch:
10% reduction in value.
Level 2. - If the product shows noticeable wear and tear or deterioration, such as a clear scratch or damage:
30% reduction in value.
Level 3. - If the product shows damage that affects its function:
50% reduction in value.
Level 4. - If the product shows severe damage and/or severe wear and tear:
60% reduction in value.
Level 5. -If the product is in such a condition that it is deemed unsaleable or that repair is not economically viable:
100% reduction in value.
Damage to product packaging
If the product packaging is missing or damaged to such an extent that it cannot be reused:
10% reduction in value.
Certain products are exempt from the right of withdrawal under the Distance and Off-Premises Contracts Act (2005:59):
-Products that have been manufactured or modified specifically at the customer's request or that have otherwise been given a special character.
-Products that are likely to be destroyed, consumed or significantly deteriorate during the withdrawal period.
-Sealed hygiene products that are likely to be damaged for health or hygiene reasons and where the customer has broken the seal.

30-day open purchase
An open purchase is offered for 30 days from the date the product is delivered to you.
During the open purchase period, Hulténs I Sverige AB will repurchase products at the price you paid for them, excluding shipping costs to the customer. The customer is responsible for the cost of return shipping when using the open purchase option. Hulténs I Sverige AB will not reimburse the cost of any other services provided.
The following conditions apply to open purchases:
-The product must be unused and in undamaged condition.
-The product must not have been assembled.
-The original packaging must be in undamaged condition.

14-day right of exchange
You have the right to exchange a product within 14 days of the product being delivered to you. When exchanging a product, you will receive the value of the products you return, including any shipping costs you have paid, as a credit note from Hulténs I Sverige AB. Credit notes for products that have been repurchased will be deducted from the value of the products you order when exercising your right of exchange. If the value of the products you have ordered exceeds your credit balance, you must pay the difference to Hulténs I Sverige AB. If the value of the products repurchased exceeds the value of the products ordered in connection with the exchange, you can use the difference as credit towards your next purchase from Hulténs I Sverige AB. When returning products in connection with an exchange, you as the customer are responsible for paying the return shipping costs.
The following conditions apply to exchanges:
-The product must be unused and in undamaged condition.
-The product must not have been assembled.
-The original packaging must be in undamaged condition.

The right of withdrawal applies from day 1 to day 14 from receipt of the goods, after which the open purchase (with its terms and conditions) applies and the right to open purchase expires 30 days after receipt of the goods.
9. Complaints and warranty
Right of complaint
Customers who have purchased a product as a private individual have the right to complain about the product if it is faulty in accordance with the Consumer Sales Act (2022:260) and the Consumer Services Act (1985:716). The right to complain covers original defects and is valid for 3 years from the date the customer received the product. If the defect is discovered just before three years have passed, you have an additional 2 months to complain about the product. The right to complain also covers defects that occurred during transport of the product to the customer. (See Complaints about transport damage below). A product that differs from what has been agreed between the customer and Hulténs I Sverige AB or otherwise shows defects may also be considered defective. Defects caused by damage caused by the customer are not considered original defects.
Product defects must always be reported within a reasonable time after the defect should have been discovered. Hulténs I Sverige AB therefore always recommends that products be inspected upon delivery and that any defects be reported as soon as they are discovered. When complaining about a defective product, you as a customer are primarily entitled to have the defect remedied or to receive a defect-free product. In certain cases, you are also entitled to cancel the agreement and receive a refund. If the complaint is approved, the customer shall be compensated for any costs incurred as a result of the complaint. For example, the costs of returning a faulty product shall be reimbursed by Hulténs I Sverige AB. Please note that, as a customer, you shall minimise any costs incurred in the event that a product proves to be faulty. In the event of a complaint, each party shall return what it has received without undue delay. If Hulténs I Sverige AB is to make a replacement delivery, the customer is entitled to keep the faulty product in their possession until they have received delivery of a fault-free product.

Complaints terms and conditions for business customers
If a product differs from what has been agreed between the customer and Hulténs I Sverige AB or otherwise exhibits defects for which Hulténs I Sverige AB is responsible, the customer is entitled, in the first instance, to have the defect rectified and, in the second instance, to have the product replaced at Hulténs I Sverige AB's expense. The right to complain about defects only applies if the defect is original; Hulténs I Sverige AB's liability is limited to the value of the defective product. Defects in products must be reported within 14 days of delivery by contacting Hulténs I Sverige AB via email at support@hultens.se.
Special terms and conditions for business customers:
-The product must not have been assembled after the defect was noticed.
-The original packaging must be saved and kept in undamaged condition.

Is your item faulty?
Two months is considered a reasonable time for discovering a fault/damage to an item ordered.

When returning products or materials to Hulténs I Sverige AB, the products must be packaged in such a way that they are protected during transport. Hulténs I Sverige AB therefore recommends that you always pack products in the same way and with the same packaging as when the products were delivered to you.
If you, as the customer, have been careless in your choice of packaging or choice of carrier in such a way that the product is damaged during transport to Hulténs I Sverige AB, you as the customer are also responsible for the damage.
When returning products to Hulténs I Sverige AB, you are responsible for ensuring that the products reach Hulténs I Sverige AB in undamaged condition. Hulténs I Sverige AB recommends that customers use traceable shipping when returning products. Returns should always be sent back to:

Instructions on the return procedure are included in every shipment. If these are missing, please contact us.
Refunds
Hulténs I Sverige AB will refund the money without undue delay if you exercise your right of withdrawal or open purchase, or if a refund has been decided in a complaint case.
Cost of return:
As a customer, you are always responsible for the return shipping costs.
Please contact us at support@hultens.se to find out the cost of any returns. Alternatively, contact a transport company and provide the weight and dimensions of the goods.
11. Reservation
Reservation of title
All products are subject to reservation of title until the customer has fulfilled their obligations under this agreement.
This means that ownership is transferred to the customer when the customer fulfils their obligations under the agreement. The customer is therefore not entitled to consume, use, sell or otherwise take any action before ownership has been transferred to the customer that prevents the products from being returned to Hulténs I Sverige AB.
Right of cancellation
Hulténs I Sverige AB reserves the right to cancel the agreement in the event that the customer has acted in bad faith due to errors that the customer was aware of or should have realised, such as incorrect information about price or quantity on the website. In the event that the right of cancellation is exercised, the customer is not entitled to damages or other compensation from Hulténs I Sverige AB.
Right to make changes
Hulténs I Sverige AB reserves the right to change the content of the website without notice, including, but not limited to, the range of products, prices and promotions. However, such changes do not affect agreements already entered into between Hulténs I Sverige AB and the customer.
Disclaimer
Hulténs I Sverige AB shall be deemed exempt from all obligations under this agreement if liability would otherwise arise due to events outside the scope of this agreement, Hulténs I Sverige AB's operations or what otherwise follows from mandatory law.
12.
Force Majeure
In the event of action or omission by public authorities, new legislation, labour disputes, war or threat of war, major disruption of public order, sabotage, extreme weather conditions, fire, explosion, natural disaster, accidents or other circumstances beyond Hulténs I Sverige AB's control and which Hulténs I Sverige AB could not reasonably have overcome or foreseen, the Consumer Sales Act shall apply. In such cases, Hulténs I Sverige AB shall not be liable for any damage suffered by the customer.
External links
Hulténs I Sverige AB is not liable for any damage or problems with the customer's software or hardware arising from the customer's use of external links published on http://www.hultens.se.
Reservation for price fluctuations, final sale or other trade barriers
We reserve the right to make errors in text or images, final sales or supplier delays. In the event of price fluctuations or other trade barriers, such as a shortage of necessary components, where Hulténs I Sverige AB cannot reasonably be held to its obligations under this agreement, Hulténs I Sverige AB has the right to cancel the agreement. In such an event, the customer is not entitled to damages or other compensation from Hulténs I Sverige AB.
Reservation for changes in taxes and fees
In the event of significant changes in taxes or fees that are of major importance to the conditions of this agreement, Hulténs I Sverige AB shall be entitled to terminate the agreement. In such an event, the customer shall not be entitled to damages or other compensation from Hulténs I Sverige AB.
13. GDPR and privacy/personal data
Information such as personal data or other information or parts of documents that the customer provides to Hulténs I Sverige AB will be stored and processed in digital format. Hulténs I Sverige AB is responsible for ensuring that the information is stored and processed in accordance with the Personal Data Act. The customer's information will be used by Hulténs I Sverige AB to enable and ensure the fulfilment of the Agreement.

Register extract:
If you, as a customer, have entered into this agreement as a private individual, you are entitled to request a register extract once a year free of charge. A register extract specifies what information is stored about you.
You can request this by sending a signed request to the above postal address. If the information we have about you is incorrect, incomplete or misleading, we will of course correct it.
Deregistration of customer information:
As a customer, you can request in writing and with your signature that your customer information be deleted from Hulténs I Sverige AB, with the exception of information required for Hulténs I Sverige AB to maintain good accounting and bookkeeping practices.

Reporting
Hulténs I Sverige AB routinely reports all fraud, attempted fraud and malicious orders to the police.
Discrepancies between different publications
If there are differences between information on the website and other publications, the information provided on the website shall take precedence. However, this does not apply to information that is clearly incorrect or misleading when comparing the different publications.
Intellectual property rights, logos and trademarks
All material published on the website, including software, logos, audio files, trademarks and text & images, is protected by intellectual property rights. This protection means that the material may not be used without the permission of the copyright holder, nor may the material be copied or otherwise transferred to third parties without the express permission of Hulténs I Sverige AB. Any violations will be prosecuted.
Purpose of the information
All information on the website, regardless of format, is published solely for informational purposes to enable visitors to use the website. Hulténs I Sverige AB is therefore not responsible for any consequences or damage that may arise if this information is used for any purpose other than that stated above.

If the customer is a private individual and has entered into this agreement for private consumption, disputes shall be settled by the court of law that follows from mandatory legislation. In the event that a case is brought before the General Complaints Board, Hulténs I Sverige AB will comply with the Board's decision.
